Micro-Mobility Devices (MMD) Policy

Purpose

This policy establishes responsibilities and procedures to ensure safety in the use of, or the charging of, any type of battery-equipped Micro-Mobility Devices (“MMD”).

Scope

This policy applies to Seton Hall University (the “University”) students, faculty, staff, employees, and visitors to the campuses.

Definitions

The following definition is applicable to this policy:

  1. Micro-Mobility Devices (“MMD”) are devices designed to transport an individual from one location to another, such as, but not limited to, E-Bikes, E-Scooters, E-Hoverboards, E-Skateboards or any other type of micro-mobility devices requiring a battery or rechargeable battery to power movement.

Policy

  1. Strict Prohibition. The use, possession, storage of, or charging, of any type of Micro-Mobility Device (“MMD”), as well as the electric charging or recharging of any type of battery for MMD, inside or within 50 feet of any building, shed, tent, canopy, parking deck, or other enclosed or partially enclosed structure on any University premises, including any campus or other location under the control of, or leased to, the University, for any length of time and for any reason is strictly prohibited. This includes, but is not limited to, on or off campus residence halls, classrooms, academic buildings, office or administrative buildings, facility or support buildings, recreational, assembly, or other structures used for entertainment, cooking or dining, athletic activities, parking areas, or any location that is deemed by the University to be susceptible to a possible fire, explosion, hazard or risk to the safety of the University community members if such MMD were present.

  2. Registration. MMD shall require a valid authorized University MMD permit issued by the University’s Parking Services. Permit fee is a “no cost” fee.

  3. Parking/Storage. MMD cannot be secured to University light poles, benches or trees, as this can damage University property. MMD must be secured to an approved bicycle rack that is not located underneath any University building or property. MMD that are not secured to an approved bicycle rack will be impounded by Public Safety. University community members may not leave MMD attached to bicycle racks beyond the end of the semester.

  4. Impoundment. Any prohibited MMD found unattended will be impounded. The University is not responsible for damage to MMD that occurs during impoundment and has no responsibility or liability to replace, or make compensation, for MMD.  Impounded MMD must be collected by the owner and removed from the University premises prior to the end of the semester in which it was impounded. Impoundment incurs a $25 storage and recovery fee. Reimbursements will NOT be issued by the University for any locks removed or cut on MMD by the University during the impoundment process. If impounded items are not retrieved by the owner within thirty days (30) or before the end of the semester (whichever is later), they will be disposed of in accordance with University policy.

  5. Exemptions. Authorized exemptions shall be restricted to automobiles manufactured and sold by authorized automobile dealers and medical devices (i.e. Wheel Chairs) manufactured by authorized dealers that meet the Underwriters Laboratories (UL) testing standards and approval.

  6. Right of Inspection. The University shall maintain the right of inspection of, and approval or denial, of all MMD on all University premises.

  7. Reservation of Rights. The University reserves the right to further limit or prohibit the use of MMD in order to preserve the safety of the University community.

Violation of Policy

Violation of this University policy will result in a summons and a fine of $25. Repeated violations may result in suspension of privilege, revocation of the University permit, prohibition of the MMD on any University premises indefinitely, as well as civil and/or criminal penalties.
